A person may be eligible to request for the removal of their criminal history record under the following circumstances, as stated in the Pennsylvania Consolidated Statutes § 9122:

  • A person may begin the expungement procedure if, eighteen months after the arrest, there is no outstanding matter before the court.
  • A person may be eligible for the expungement of their criminal history record when a court order has been issued to erase non-conviction data.

Eligible persons may request an expungement process by completing and printing Form SP 4-170 (Request for Individual Access and Review). They are required to mail the completed Form, along with a certified check or money order for $20 payable to the Commonwealth of Pennsylvania, a copy of a government-issued photo ID, and a legal affidavit to the Central Repository address listed on the Form.

After submitting the completed application, the applicant will receive a letter from the Central Repository containing their complete arrest history. The individual can then examine the record and obtain further guidance on how to petition the court for expungement by contacting the Clerk of Courts in the county where the arrest occurred.

Upon approval of the petition, the court will issue an order for expungement. The Pennsylvania State Police are required to expunge the records as soon as they receive the court order.
